    Who can make a claim?

    Anyone can enquire if they believe they have been left with disabilities after being administered a COVID-19 vaccine. At Oakwood Solicitors, we can advise if you are eligible for a Claim relating to Vaccination you have had that has caused injuries both minor and lifelong.

    You may also be entitled to claim on behalf of a deceased relative. However, we would have to ensure that there was a Will in place, if not a Grant of Probate has now been put in place, otherwise we would have no legal standing to submit a claim for the vaccination.

    What is the process to make COVID-19 vaccine claim?

    1. The first step in claiming an injury suffered as a result of a vaccination is enquiring with us to establish the two legal tests Breach of Duty and Causation.
    2. If we believe you have an eligible claim, the next step would be signing up to our Damages Based Agreement.
    3. We then obtain the Client’s GP records in order to conduct our own investigations before submitting the Claim form through the government portal.
    4. We then take a brief witness statement from the Client to complete a part of the claim form which forms the details of what has happened.
    5. From there we complete the Claim form on behalf of the Client.
    6. The Claim then goes through many stages of being assessed by all the relevant criteria before a conclusion is established.
    COVID Vaccine Compensation Claims

    How will compensation be obtained?

    The compensation will be obtained through the government’s Vaccine Damage Payment Scheme where there is a standard tax-free payout of £120,000.

    There will be a standard 25% taken off of this compensation received in order to cover our legal costs. The remaining amount will be awarded to the Client.

    What types of injuries can you claim for?

    There is an increasing number of injuries that have come to light as a result of a COVID-19 vaccine that has been administered recently. The examples below are some of the many injuries and complications faced after having vaccinations, in particular the COVID-19 Vaccines.

    However, this list is not exhaustive and if you have suffered from other injuries, please get in touch.

    • Vaccine-induced immune thrombocytopenia and thrombosis (VITT)
    • Myocarditis or Pericarditis
    • Stroke
    • Death
    • Optic Neuritis, Uveitis, Bell’s Palsy
    • Blood clots caused by COVID Vaccine*

    *According to Public Health, there have been a number of reports in both the UK and Internationally of thromboembolic events (Blood Clots) and thrombocytopenia (Low Platelets) following the first dose of the AstraZeneca Vaccine since March 2021.

    How will it be proven that injuries were caused by the vaccine? 

    Many investigations are conducted when going ahead with a claim arising from a vaccination you have been administered.

    The main factor that is investigated is whether you have “at least 60% disability” after being given the jab. Please see below the guidance that the medical assessors rely on to conclude the Claims.

     

    • The Green Book

    The Green Book is a PHE resource and guidance that is continuously updated containing information regarding vaccinations. The Green Book brings together all the information relating to the immunisation of infectious diseases.

    It provides information on how and when the vaccines came about, what they were to do, side effects and eligibility to have the vaccine.

     

    • Medicines and Healthcare products Regulatory Agency (MHRA):

    The MHRA includes data from the Yellow Card. The Yellow Card documents information on suspected safety concerns for all Healthcare Products.

     

    • Causality Assessment of an adverse event following an immunisation:

    This assessment is completed by the World Health Organisation (WHO) to evaluate the likelihood that a particular treatment (in this case, the COVID-19 vaccine) is the cause of an observed adverse event.

    It essentially means finding a causal association or relationship between a drug and a drug reaction.

    What is considered a ‘60%’ disability?

    To receive a payout, it must be proven that the Vaccine led you to suffer severe disabilities amounting to 60%.

    The government published guidelines in order to assess the severity of each disablement. The medical assessor uses this in order to establish if the Claimant has suffered 60% or above regarding their disability.

    Which vaccines can I claim for?

    The majority of the interest for the Vaccination claims has been in relation to the COVID vaccines and boosters however, we have two claims regarding the MMR Vaccine.

    The Vaccine Damage Payment Scheme focuses on the following vaccinations:

    You could get a payment if you’re severely disabled and your disability was caused by vaccination against any of the following diseases:

    • Coronavirus (COVID-19)
    • Diphtheria
    • Haemophilus influenza type b (Hib)
    • Human papillomavirus
    • Influenza, except for influenza caused by a pandemic influenza virus
    • Measles
    • Meningococcal group B (meningitis B)
    • Meningococcal group C (meningitis C)
    • Meningococcal group W (meningitis W)
    • Mumps
    • Pandemic influenza A (H1N1) 2009 (swine flu) – up to 31 August 2010
    • Pertussis (whooping cough)
    • Pneumococcal infection
    • Poliomyelitis
    • Rotavirus
    • Rubella (German measles)
    • Smallpox – up to 1 August 1971
    • Tetanus
    • Tuberculosis (TB)

     

    You may have had a combined vaccination against a number of the diseases listed. For example, you might have been vaccinated against DTP (diphtheria, tetanus and pertussis) or MMR (measles, mumps and rubella).

    You may also be able to get a payment if you’re severely disabled because either:

    • Your mother was vaccinated against one of the diseases on the list while she was pregnant
    • You’ve been in close physical contact with someone who’s had an oral vaccine against poliomyelitis

    AstraZeneca Vaccine - Can I make a claim?

    Yes, AstraZeneca is one of the COVID-19 vaccines for which you can claim compensation.

    There have been many reports of issues occurring after patients were administered this jab. Meanwhile, in April this year, the company admitted that the jab wasn’t entirely safe and that ‘in very rare cases’ it can cause a type of blood clotting called thrombosis with thrombocytopenia syndrome (TTS).

    It has since been discontinued.

    Time limit to make a claim?

    For Vaccination Claims, the limitation period is extended to 6 years rather than the 3 years for Clinical Negligence Claims.

    However, if the recipient was a Child then the limitation date would be their 21st Birthday, as it is 3 years from the Client turning 18.
