In Ghaith v Indesit Co UK Ltd  EWCA Civ 642 the Court held that an employer was negligent in failing to undertake a suitable and sufficient risk assessment at work. The Claimant had been asked by his employer to clear out his van and the claimant injured his back in doing so. The case demonstrates the burden on employers to ensure the safety of staff members.
In Blair v Chief Constable of Sussex Police  EWCA Civ 633 the Court found that the employer had breached the Personal Protective Equipment Regulations by failing to provide stronger boots. The judge held that when assessing if the regulation has been breached it was necessary to identify risk of injury and then assess the effectiveness of the equipment.
