The Claimant attended hospital for a suspected DVT. She was discharged home with some medications, including Hydroxycarbamide and Phenoxymethylpenicillin.
When home, the Claimant began to experience symptoms of nausea, abdominal pain, generalised weakness and racing heartbeat. Around one week later, she began to experience hair breakage when brushing her hair.
The Claimant checked her medications against her discharge letter, and found she was only supposed to be taking Apixaban and Co-amoxiclav.
The Claimant attempted to contact the Defendant Trust multiple times but got no response. Her symptoms lasted for approximately four weeks, but she still experienced hair thinning.
The Defendant made admissions of liability and an opening offer of settlement for £7,500.00. The Claimant accepted the Defendant’s offer shortly afterwards.
Claims of this nature are subject to a three year limitation period. This means that claims have to be commenced within the Courts in three years of rather the date the negligent act occurred or the date you became aware that negligence had occurred.
In cases involving deceased victims this limitation period commences from the date of death and in cases involving minors, the limitation period starts when they reach their 18th birthday.
