On 25 February 2013 Pay and Benefits Magazine published an article discussing various recent employment tribunal hearings including that of Lall v Royal Mail Group Ltd  All ER (D) 272 (Jan).
The article summarises that "A sub-postmaster was dismissed after his wife was found to have committed fraud. The employment tribunal accepted that the employee had not known about his wife’s actions and therefore he should not have been dismissed."
The article explains that "The employee worked for the Post Office division of the employer for about 30 years and had an unblemished record. For many years he had been a sub-postmaster in Worthing. In February 2008 he was directly employed as a counter clerk in Shoreham. The employee left the duties at Worthing to his wife and she committed fraud that the employee contended he had not known about. In October 2010 his contract at Worthing was terminated when his wife’s wrong-doings came to light. The employee was charged with failing to meet the employers conduct standards as a result of this breach of contract as sub-postmaster at Worthing and he was summarily dismissed from his employment at Shoreham. The employee brought proceedings before the employment tribunal alleging unfair dismissal."

The above-mentioned article informs of that "The tribunal noted that the employer had attached considerable significance to the perception that the employee had been implicated in his wife’s actions and that it had been "inconceivable" that he had been unaware of them finding that the integrity had been brought into question."
It went on to say "The tribunal found that there had been no evidence upon which to reach those conclusions. They found that any reasonable employer in a similar business in the same circumstances could not dismiss summarily."
The article then tells us that the employer appealed against the decision but the appeal would be dismissed.
