    Legal Expenses Insurance (more commonly known as LEI) is a form of insurance that covers expenses incurred during legal disputes, for example an unfair dismissal case before an Employment Tribunal.

    Standalone cover can be bought, however it is more commonly found to be an add-on to Home Contents Insurance, other types of insurance or as part of the benefits of premium bank accounts/credit cards.

    How do I know if I have legal expenses insurance (LEI)?

    If you think you may be covered as part of a house content policy then details of the cover should be contained within the insurance schedule.

    I have not got legal expenses insurance. Should I get it?

    Like all insurance, you are insuring against the risk of something happening even though it may not happen.

    If you are already in dispute with your employer and do not have LEI then it may be too late for that policy to cover the issue in dispute. However, this will depend on the terms of the LEI you take out.

    Who can represent me?

    Insurance providers usually have their own panel of solicitors who they regularly appoint and will suggest that you use their panel for ease and the likelihood that they will be charged lower fees.

    Whilst this may be their preference, it is a person’s legal right to choose their own solicitor from the point litigation commences (for employment matters this is usually when you or your solicitors starts Early Conciliation), however, case law confirms that you may be able to choose your own solicitor as early as the enquiry stages.

    If your insurer is suggesting you use their panel legal representatives, but you would like to instruct Oakwood Solicitors Ltd then please let us know and we will assist you to obtain cover towards the cost of our service.

    When will my legal expenses insurance cover start?

    In an attempt to keep costs down, some insurers will not cover your claim until a case has begun (as mentioned above). Others may allow cover from the initial advice given by your solicitors prior to the start of ACAS Early Conciliation.

    It is important you check with your insurance provider when your cover starts, as you may be liable for any fees incurred by your solicitor prior to this.
