Since the news appeared suggesting that Volkswagen (VW) illegally used software to cheat the US emissions tests, Oakwood Solicitors have been busy collecting the full facts and evidence around these potential VW claims.

We have been approached by hundreds of vehicles owners who potentially would like us to represent them in a VW compensation claim against the car maker.

We now know that Volkswagen Group vehicles (VW, Audi, SEAT and Skoda) have all been guilty of using the ‘deceit device’ and we are collecting further evidence about this all the time.

This isn’t the first time this has been tried, back in 1973, Chrysler, Ford Motor Company, General Motors, Toyota, and Volkswagen had to remove ambient temperature switches which affected emissions, the manufacturers said that they didn’t cheat on purpose and overall fines were very low. This time it’s different and Volkswagen compensation is expected to be significant.

Which cars are affected?

Volkswagen have admitted that 11 million cars globally (1.2m in the UK) have this cheat software installed (although they do say that the software does not affect the performance, safety or security of them). Reports suggest that Jettas, Beetles, Audi A3s, Golfs and Passat models are affected. SEAT, Skoda and VW Commercial vans also have their ‘cheat device’. On 2 Nov, the Environmental Protection Agency (EPA) in the United States also named Porsche as an affected brand.

As the picture in the UK becomes clearer, this page will list all known vehicles.

The following vehicles sold in the UK, are all known to have the Volkswagen EA189 engine:

2009-2015 Audi – A1, A3, A4, A5, TT, Q3 and Q5 (all 1.2L, 1.6L and 2.0L TDI models)

2016 Audi A6 Quattro; A7 Quattro, A8, A8L and Q5 (all 3.0 litre V6 diesels). Source: The EPA.

Is my car affected?

Volkswagen has said that they are in the process of contacting owners of affected vehicles and that they will start repairing them from January 2016.

You can confirm whether your vehicle is affected by checking the VIN (Vehicle Identification Number) against these sites:

You can find your 17 digit VIN either in the bottom left hand corner of your windscreen (passenger side) or in the front of your service book.

The VIN will look like this: WVWZZZ1JZXW000010
Please take care when entering your VIN, for example do not mistake ‘0’ for ‘O’.

What is wrong with the cars?

Reports from the US are suggesting that the Volkswagen EA189 diesel engine could emit up to 40 times the amount of nitrous oxide that appears in test readings when driven in the real-world.

Volkswagen stress that the software does not threaten the safety or security of the vehicles, so there is no need for drivers to worry.

Will I be able to claim against Volkswagen?

Volkswagen have admitted that they have done something wrong, their own Chief Executive even said “We’ve totally screwed up”, they have now set aside an initial €6.5bn (£4.7bn) to cover fines and compensation claims. Yes, Volkswagen have done wrong and as an owner, you do have a potential Volkswagen claim.

What exactly can I claim for?

We know that Volkswagen did indeed use software to cheat EU emissions tests, this means that they are in Breach of Contract. Not only that, but these cars are likely to have used more fuel than they should have.

It’s also possible that as a premium was paid for these ‘cleaner’ cars, owners will need compensating for any increased loss in the value of their vehicle.

It is also likely to be more costly for car tax for you in the future, and there is a chance that the technical solution to fix this issue by Volkswagen could cost you in the future for additional maintenance, also taking your vehicle into a local garage and having it off the road for a day or two for the VW recall could leave you out pocket. Ultimately your VW vehicle could be worth less than you think when you come to resell it.

These Volkswagen claims, as with all product claims that we process, will be looked at through a whole host of potential UK and EU Laws and Litigations.

How much compensation might I receive?

We do not know the answer to that yet. Volkswagen claims will be processed as they have admitted cheating the emissions system. Some reports in the national press have suggested that compensation of up to £3,000+ is likely. Whilst we can’t confirm this figure at this early stage, as many owners have paid £’000’s as a premium for these ‘greener’ cars, then it is a possibility.
