POWERS OF ATTORNEY

There are several types of Powers of Attorney and we at Oakwood Solicitors will provide you with advice and guidance as to which Power of Attorney you require for your individual personal needs.

We will:

  • Prepare your Power of Attorney
  • Register your Lasting or Enduring Power of Attorney with the Office of the Public Guardian
  • Provision of a certificate for your Lasting Powers of Attorney
  • Cancel any existing Power of Attorney

Lasting Powers of Attorney

No one knows what may happen in the future but we all know that we get older and with this comes the possibility of physical or mental incapacity. To give you peace of mind for the future we recommend that you prepare a Lasting Power of Attorney. You choose who will deal with your affairs should you become unable to deal with them yourself.

Your Lasting Powers of Attorney are prepared to look after your Property and Financial matters and your Health and Welfare matters.

You choose:

  • who you want your attorneys to be,
  • how your attorneys are to assist you ; and
  • when they can assist you.

We will:

  • provide you with in-depth advice concerning your Lasting Powers of Attorney
  • prepare your Lasting Powers of Attorney
  • provide you with a certificate of understanding
  • assess your entitlement to any reduction of the registration fee payable
  • register your Lasting Powers of Attorney with the Office of the Public Guardian
  • store your Lasting Powers of Attorney until they are required to be used (FREE of charge)
  • provide guidance to your Attorneys once your Lasting Powers of Attorney are required to be used
  • offer you a fixed fee for all work in relation to your Lasting Powers of Attorney
  • Offer additional services for New & Existing attorneys
Lasting Powers of Attorney for Business Owners

As a business owner/co-owner you have worked really hard to make your business a success, so you should consider making a Lasting Power of Attorney to cover your business assets should any of the following happen:

  • Accident resulting in long-term/temporary incapacity or impairment
  • Long term illness
  • Out of the country for a long period of time
  • Receive a custodial sentence

You make the decision:

  • Who will be your business attorneys;
  • How your attorneys are to assist you; and
  • When they can assist you.

We Will:

  • Provide you with in-depth advice concerning your Lasting Power of Attorney to cover your business assets
  • Prepare your Lasting Power of Attorney for property and financial affairs for your business assets separate to your Lasting Power of Attorney dealing with your personal assets if appropriate
  • Provide you with a certificate of understanding
  • Assess your entitlement to any reduction of the registration fee payable
  • Register your Lasting Power of Attorney with the Office of the Public Guardian
  • Store your Lasting Power of Attorney until they are required to be used (FREE of charge)
  • Provide guidance to your Attorneys once your Lasting Powers of Attorney are required to be used
  • Offer you a fixed fee for all work in relation to your Lasting Powers of Attorney for your business assets

You may wish to prepare a Lasting Power of Attorney for Health & Welfare or  a Living Will/Advanced Directive

Oakwood Solicitors offer a discounted service for the preparation of Lasting Powers of Attorney for business assets prepared for co-owners of the same business as  part of their business set up.

ENDURING POWERS OF ATTORNEYSince 1 October 2017, no further Enduring Powers of Attorney can be made (they were replaced by Lasting Powers of Attorney).

If you made an Enduring Power of Attorney prior to this date, it is still valid and can be used. If, however, your Enduring Power of Attorney is required to be changed then you will need to make a Lasting Power of Attorney .

If your attorney believes that you have become or are becoming mentally incapable, then your Enduring Power of Attorney is required to be registered with the Office of the Public Guardian.

We will:

  • prepare all of the necessary registration documents
  • assess your entitlement to any reduction of the registration fee payable
  • register your Lasting Powers of Attorney with the Office of the Public Guardian
  • offer you a fixed fee for all work in relation to the Registration of your Enduring Power of Attorney
  • Offer additional services for New & Existing attorneys

Your Enduring Power of Attorney only covers your Property and Financial Affairs so you may wish to consider making a Lasting Power of Attorney for Health and Welfare and/or a Living Will/Advance Directive, to deal with your Health and Welfare matters.

Oakwood Solicitors will offer you a free half hour appointment to review your existing Enduring Power of Attorney to ensure that it continues to meet your needs.

General Power of Attorney

A General Power of Attorney may be appropriate if you are able to provide instructions to your chosen attorney to deal with your property and financial affairs, on your behalf, for use on a short-term basis.

For example:

  • If you are physically incapacitated following a medical procedure
  • |Out of the country for a specific length of time
  • Have received a custodial sentence

We will:

  • Provide you with in-depth advice concerning your General Power of Attorney
  • Personalise your General Power of Attorney to meet your individual needs
  • Offer you a fixed fee for all work in relation to your General Power of Attorney

You may also wish to prepare a Lasting Power of Attorney and or a Living Will/Advanced Directive for future use.

Cancelling your Power of Attorney

If you have made any Power of Attorney and you no longer wish for the attorneys currently appointed to be your attorneys, then you can cancel your existing Power of Attorney and make a new Power of Attorney.

We will:

  • Provide you with in-depth advice with regard to the cancellation of your Power of Attorney
  • Prepare the Deed of Revocation of your Power of Attorney
  • Prepare any new power of attorney if required
  • offer you a fixed fee for all work in relation to the cancellation of your Power of Attorney and the preparation of your new Power of Attorney
