Owner of the station Steve Jones made a call after he believed that he had been broken into. Kelly Jones and her colleague attended the scene in Thetford Norfolk just under two years ago.
PC Jones’ decision received criticism from her own colleague chief constable Phil Gormley who described the claim as “Surprising and disappointing.”
Head of the Employers and Public liability department Michael Long feels that it’s someone’s responsibility to make sure their property or land is safe.
“Any owner or occupier of land has a duty of care to any person they invite onto their land whether it be a friend member of the public an employee or a member of the emergency services.”
He also believes she is entitled to claim.
“If someone is injured due to a defect on the property that the owner or occupier knew or ought to have known about then the injured party has a right to claim compensation for their injuries and associated losses. The officer is simply exercising her right to claim compensation and it will ultimately be for the Court to decide if she has a reasonable case or not.”
The federation who represent rank and file officers Police Federation of England and Wales (PFEW) report that nearly £70 million was paid out in settlement to injured officers in the last four years.
