    The Claimant, a young woman, was invited to the residential property and was expected by the owner.

     

    Although the Claimant had not visited the property before, she was aware that there was a large breed of dog at the property.

     

    Dog Attack

     

    She did not know any further information about the dog. The Claimant was not alarmed by this as she was an owner of a large breed of dog herself, and also helped out at a local dog rescue centre.

    When the Claimant got to the property, both the dog and the owner of the dog were around the back of the property behind a closed gate. The Claimant approached the property, and after making her presence known, the owner of the dog opened the gate and let the dog through into the front garden. Immediately as the dog was released it jumped up at the Claimant. She tried to protect her face by raising her arm, but unfortunately, the dog bit her on the face and arm.

    As a result of this attack, the Claimant has been left with scarring to her face and arm from the dog’s teeth puncturing her skin. She also began having nightmares about dogs and now feels wary around them, especially when she is with her children. She is self-conscious of the scarring that the attack has caused, especially the scarring to her face.

    Following some persistence, the insurance details of the Defendant were obtained, and Oakwood Solicitors detailed to the insurers the Claimant’s case. The insurers declared that they did not believe the Defendant to be at fault. Despite this, Oakwood Solicitors persisted with their arguments in support of the Claimant, and the insurers later admitted 100% liability on behalf of the Defendant.

    A dog attack is extremely distressing. Not only is the event itself often a scary and shocking experience, many dog attacks result in permanent injuries, such as scarring and nervousness around animals.
