Miss Kitching was employed by a nursing agency and was contracted to work at least 35 hours per week full time. She was often given more hours as she was extremely popular amongst her home care clients. She was extremely dedicated to her job.
When Miss Kitching contracted glandular fever her doctors told her she had to have at least 1 month absent from work. She then contracted a post viral illness that left her almost unable to move. She informed her employers she would need another month off to recover. When she was ready to return to work her employers were extremely difficult with her.
“I rang them and said I was ready to go back to work and could they please send me my rota. They sent me a month’s rota with only 40 hours on for the whole month. They said it was because they had found others to replace my hours as I had been off for so long. I was contracted at least 35 per week.
