    It is very saddening that in our society, a high percentage of sexual and physical abuse occurs within the family or is committed by someone close to the family or in the local community.

    Unless the abuse occurs within an institutional or organisational setting, the only option may be to look at whether a claim can be brought against the individual abuser.

    Claims Against Individual Abusers

    How can I bring a claim against the person who assaulted me?

    Abuse and assaults are classed as civil wrongs, and in principle – if you are able to prove the assault, the law can order that the individual pays you compensation.

    The difference is that in the case of an institution or organisation, they will likely have assets or insurance that will cover such claims, and they will in almost all cases comply with their legal obligations to respond to claims – usually with appointed solicitors to advise and act for them.

    Where proceedings are brought against an individual or a claim is notified, that individual may ignore the claim or may refuse to cooperate or comply with the legal rules and procedures.

    Whilst, ultimately, the law will not allow the person to ‘get away with it’ by ignoring correspondence or court papers, it can mean that the case has to be progressed through the court system, which may take longer and be more uncertain.

    If you win your case and the court orders them to make payment, whether payment is made will again depend on their co-operation and also whether they actually have any money to pay.

    In what circumstances would you advise that I sue the individual?

    We want to avoid additional stress and uncertainty for you. We therefore generally look for two things when looking at whether we should advise you to proceed with a case against an individual:

    1. A criminal conviction or other finding that the abuse happened or an admission from the abuser.
    2. That the abusers has sufficient assets (money) to pay you your damages and your legal costs if you win.

    If a claim against your individual abuser is not possible, you may still be able to recover compensation from the Criminal Injures Compensation Authority (CICA).

    How much is my claim worth?

    Your solicitor will assess your claim and give you an idea at the outset of the likely compensation payable. Civil claims for abuse can include the following compensation:

    • General damages – An award of money for the abuse/assault(s) themselves and for the pain, suffering and any psychological effects.
    • Special damages – An award for any specific financial losses we can prove, such as loss of earnings or the costs of any treatment or counselling.
    • Aggravated damages – An additional award of money in certain cases where the court considers that there has been additional distress caused by the manner in which the abuse occurred.

    How long will my case take?

    Once we have been able to assess your case, we will give you an idea at the outset of the likely timescale.

    It is more difficult to predict in cases where we are suing an individual, as they may cooperate or comply with the procedural rules in the same way an organisation would.

    Generally, a civil claim for abuse or assaults can be concluded within 6-12 months. We will provide you with regular updates as your claim progresses.

    How will my case be funded?

    The majority of civil abuse claims are funded by a Conditional Fee Agreement (CFA). This is also known as a ‘no-win, no-fee’ agreement.

    The way these agreements work means that you do not have to pay anything upfront. If you successfully recover damages, the majority of your costs will be paid by the other side.

    You may have to contribute to costs out of any compensation recovered, but this will not be more than 25%.

    We may advise you to take out After the Event (ATE) Insurance in your claim, depending on the case. If we consider that this should be taken out we will discuss this in detail with you.

    Any ATE premium will only be payable if you win and will not need to be paid until the end of the claim.
