Debt recovery process:
- In many cases our initial action will be to issue a Letter of Action on behalf of your company demanding payment within a set time scale. The Letter of Action has a much higher success rate than correspondence sent by your own company. This is because the vast majority of customers will not want to get involved in legal action.
- Legal Claim- if your debtor does not respond to the letter of action, then the next stage is to issue legal proceedings through the County Court.
- County Court Judgement (CCJ)– a CCJ is a court order that confirms that the debtor has defaulted on payment. A CCJ can be obtained immediately after expiry date of the County Court Claim. The CCJ is the final decision by the court which gives power to take enforcement action in order to collect the debt.
- Enforcement- once a CCJ has been obtained, it is then possible to ‘enforce’ that debt immediately.
