    If you have been
    injured while
    working in a
    supermarket,
    talk to the
    experts.

Are you a supermarket employee who has had an accident at work?

Supermarkets can be busy places and unfortunately accidents do happen. These accidents often happen very suddenly, and can cause painful, long-lasting injuries. Whether the incident took place in the car park, the aisles, the petrol station, café or on anywhere on the premises, the supermarket could be responsible.

What types of accidents might occur in a supermarket?

What is the claims process and will I need to go to court?

If you win, any shortfall in our costs is covered by our ‘No Win, No Fee’ agreement (usually limited to 30% of damages).

If you lose, or we do not believe your prospects are higher than 50%, you will not be charged for the work we have done.

What accident reporting process must my employer follow?

For a company with more than ten employees, any accidents should be recorded in their accident book. In addition to any internal investigation – if an accident at work involves death, a serious injury or industrial disease, an employer must report the accident to the relevant enforcement authority. These can include the Health and Safety Executive or Local Authorities.

Will I have to go to Court?

The vast majority of claims settle before proceedings are issued and, of those that do need to proceed through the Court process, most do not need a Trial to be resolved.

Can shoppers make a claim as well as employees?

Any worker or customer can make a claim for an injury on supermarket property if it wasn’t their fault. When you are a lawful visitor to a premises, the business has a legal duty to keep you as safe as they can.

We can't speak highly enough of the fantastic work carried out by Beverley Barker on our behalf. Having had an accident at a riding stable, causing significant injury, we decided to make a claim to cover our losses. From day one Beverley was honest, sympathetic, and entirely on our side. Throughout the case, which took nearly 3.5 years to conclude, Beverley ALWAYS dealt with us in a fully professional manner, whilst really showing that she cared about us as people. The lowest point was when the defence basically made us out to be liars. Beverley totally believed in us , and kept us focused on the facts. Tenacious, determined, and very human throughout a difficult time, Beverley went the full way, as far as instigating proceedings against the defence. However, after much pressure, the defence decided they had no choice but to settle. And also at a figure way in excess of what we imagined. Brilliant service, but more. Having Beverley in your corner is like having a friend who's willing to go the extra mile. Thankyou Beverley, and Oakwood. We can finally put this all behind us.

What are my rights as an employee?

    You should be looked after

Employers have a duty of care, including a legal obligation to take practical measures to support the wellbeing of staff.

    You have protection

Legal guidelines, health and safety and reporting procedures are there to protect you from harm, but also to help you take action should an accident occur.

It doesn't matter if you've moved on

It is not a requirement for someone making a claim to still work for the intended Defendant company.

    You're not alone

Claims for supermarket accidents are very common. You can claim for an accident at work even if you're self employed or on contract work.

What do I need to do should an accident happen to me?

Seek prompt medical treatment and make sure you tell the person treating you how you were injured.

Record the accident in an accident book and report it to your manager.

If you are likely to be off work, check the position on sick pay.

If the accident was not your fault, seek legal advice to see whether you can make a claim.
