    Junior doctors in the UK have confirmed that the 72 hour strike will go ahead after what was said to be a “disappointing” meeting between the Government and the British Medical Association reps on Thursday.

     

    Should an agreement in relation to the pay dispute not be reached by 13 March, the 72 hour strike will go ahead.

    What does this mean for patients?

    It is likely that there will be appointments rescheduled and cancellations throughout the country as a significant number of junior doctors are set to walk out. In turn, many pre-booked treatments are likely to be severely affected, which will likely cause a domino effect and backlog in the treatment of patients throughout the UK.

    Where conditions that require treatment are serious and a patient doesn’t receive treatment for the same, a patient’s condition may deteriorate and/or become harder to manage.

    Healthcare professionals have a duty of care to their patients and a responsibility to provide prompt and effective treatment. If you consider that you have suffered as a result of the  strikes throughout the NHS, you may be entitled to compensation.

     

    Who can bring about a claim?

    The patient who has been affected may be able to bring about a claim. However, it can also sadly be the case that the patient has passed as a result of any lack in treatment and/or delays as a result of the recent strike action. In such instances, the executor of the estate or the next of kin/dependents may be able to bring about a claim.

    How much would my claim be worth?

    • Special damages – an award of money for all of your out of pocket expenses such as travel expenses, medication costs, loss of earnings, treatment costs both past and future. This list is not exhaustive and is very case-specific.
