Director, Head of Litigation and Contentious Trusts and Probate
Danielle Lightfoot joined Oakwood Solicitors in 2011 as a Paralegal, and qualified as a Solicitor in 2014. Danielle is a Director and Head of Civil Litigation and Contentious Trusts and Probate.
As part of our Litigation Team, Danielle specialises in financial disputes both in bringing and defending cases. She has a varied and complex caseload including;
- Claims under the Inheritance (Provisions for Family and Dependants) Act 1975.
- Disputes between beneficiaries and executors/ trustees regarding the performance of their duties in the administration of estates, including:
- Applications to remove or replace an executor.
- Applications for an inventory and account when executors are refusing to provide the beneficiaries with details of the estate administration.
- Claims against executors for breach of duty and negligence in relation to the administration of the estate.
- Disputes regarding estate property, including proprietary estoppel and constructive and resulting trust arguments.
- Challenges and investigations into the validity of a will.
- Claims for breach of contract in respect of insurance contracts, including life & critical illness insurance, income protection insurance, and buildings and home insurance.
- Claims for professional negligence, specifically in the context of financial advice in respect of pension, investment, and wealth planning.
- The provision of independent legal advice on property transactions through a Limited Company.
Danielle conducts litigation in the High Court, County Court, Probate Registry and Court of Protection.
Danielle’s approach to litigation is outcome focused, and she uses her technical and legal knowledge to works with clients to devise a bespoke strategy of how to resolve their case in a timely and cost-effective manner.
