A client who suffered angle grinder injuries to his mouth and lost a tooth, requiring ongoing future treatment as a result of an accident at work.
During his employment as a maintenance worker, our client was asked by a senior supervisor to use the angle grinder to cut some frames but had not received any form of training on how to use the equipment.
He collected the angle grinder to proceed with the job and as he powered it up, it suddenly locked and hit our client’s face, causing a deep cut to his lower lip and knocking out a front tooth.
The claim was submitted to the defendant and medical evidence was obtained. Our client paid privately for the initial dental treatment and the expert concluded that he would require further treatment every ten years, including dentures.
The defendant in this case argued that the future dental treatment would be required in any event, but we successfully argued that the medical evidence made it clear that the treatment required was accident-related. Therefore, our client would not have needed this extent of treatment had it not been for the accident.
Overall, a successful settlement was achieved for the client which included recovery of the initial fees paid to the dentist and contained a provision for future treatment.
