Claim a Power of Attorney Refund

The Ministry of Justice and Office of the Public Guardian have recently advised that if you registered a power of attorney from 1 April 2013 to 31 March 2017, you can apply to get part of your application fee back.

The refund applies to lasting powers of attorney (LPA) and enduring powers of attorney (EPA) if you made the power of attorney in England or Wales.

Who can claim?

You can claim for a refund if you are:

1. The donor – i.e. the person who made the power of attorney;
2. The attorney – i.e. the person appointed by the donor in their LPA or EPA.

The refund is only payable to the donor.

The refund can still be made if the donor has died since registering their power of attorney.

You only need to make one claim per donor, even if the donor had registered more than one power of attorney.

Even if you don’t know when you paid the fees, you can still apply for the refund.

How much is the refund?

The refund amount differs depending on when you paid the application fees.

Your refund amount will also include 0.5% interest.

If you paid a reduced application fee, you will receive half the refund amount listed below:

How to claim?

• Online; or
• By phone.

You must claim by phone if:

• the donor doesn’t have a UK bank account;
• the donor has died; or
• you are a deputy appointed by the Court.

What happens after you have claimed

Claims are taking up to 12 weeks to be processed.

If approved, the refund will be paid to the donor’s bank account.

If rejected, you can appeal the decision.

All those eligible for a partial refund on their power of attorney fees can apply from today.
