    Personnel Today published an article on Friday 17 February 2012 written by Laura Chamberlain reporting that “The Government has published an amendment to the provisions on compromise agreement in the Equality Act 2010 after employment lawyers said the wording of the Act made the agreements made under it ‘unenforceable'”.

    The article says that “Compromise contracts allow employers to breach a binding agreement with an employee which prevents individual from pursuing a discrimination claim against the organisation in return for financial payment”.

    It goes on to explain that “However shortly after the Equality Act came into force last October the Law Society argued that the wording of the legislation made compromise agreements ‘unenforceable’ as it meant that a claimant’s lawyer could not be considered to be an independent advisor. Under the legislation the claimant is required to receive advice from an independent advice before entering into a compromise agreement to ensure that vulnerable employees do not sign away their claim accidentally or too cheaply.”
