Oakwood Solicitors are preparing for the group litigation order in claims against VW, Audi, SEAT and Skoda arising from the Volkswagen emissions scandal. The emissions scandal has affected 1.2 million cars in the UK alone and this is the first group litigation order in relation to the VW emissions scandal on behalf of UK consumers.
The main allegation for the group litigation order, is that the cars in question should never have been certified as fit for sale, as they were proven to produce high levels of NOx emissions, which were far higher than stated and environmental laws allowed. Fundamentally we allege that this should give rise to damages under the Tort of Deceit.
There are also allegations that the vehicles in question only passed their official emissions tests because they were fitted with a device that reduced the amount of NOx emissions in order for them to pass the test.
