The experts in Personal Injury and Employment Law

If your health has suffered as a result of the discriminatory behaviour you are making a claim for then you have an option to include personal injury within your Employment Tribunal claim.

If you have an ongoing Employment Tribunal claim for discrimination and need some help with including a personal injury claim, we would be happy to help.

Here at Oakwood Solicitors, we have a team of mental health trained Solicitors and Paralegals who specialise in supporting clients with claims for psychiatric illness caused by stress at work. We can also help with other types of associated personal injury claims such as CFS and ME.

What support could we offer you for your Employment Tribunal claim?

    • We would be happy to undertake a free assessment of any claim where you feel as though personal injury is relevant – this would involve us having a review of any supporting documentation you have followed by a discussion with you about your legal options.
    • Written assessment of the estimated value of your personal injury claim – this is often helpful if you are in settlement discussions and need some help with the value of your personal injury claim.
    • Help with your Schedule of Loss – we would be happy to review any medical evidence you have and help you with a value to include within your Schedule of Loss.
    • Help with a settlement agreement – if you are being asked to waive your rights to make a personal injury claim then we can discuss this with you. We can also help advise you on the settlement agreement itself as this will need to be signed off by a Solicitor for you.
    • Obtain medical evidence in support of your Tribunal claim – the Tribunal does not necessarily need you to provide a formal medical report but having one is likely to bolster the strength of your evidence presented to the Judge. We can help you obtain a medical report to support your claim.
    Frequently Asked Questions

Can I make a claim in the Employment Tribunal and another claim in the County Court for personal injury?

In some limited circumstances yes but this is a complex area of law, so we would recommend getting in touch with us so that we can discuss your case in particular and provide you with specific advice.

The general rule is that where you can include all your legal issues in one claim, whether that be in the Employment Tribunal or the County Court, then the recommendation is to do so.

We are specialists in this often misunderstood area of law and would be happy to discuss your options with you at no charge.

    What are my funding options?

If you are a member of a Union or have Legal Expenses Insurance then this may cover our fees.

In some cases we can offer no win no fee as a funding option but this is ordinarily only for claims being made in the County Court.

For claims already being made in the Employment Tribunal, we would be happy to provide a quote or fixed fee to suit your requirements.

Can my GP or therapist provide a medical report?

Yes, we can look at this as a possible option for your case.

Each case is different so we can review any medical evidence you may already have and recommend the best type of medical report to consider in support of your claim.
