The Court held that so long as all Claimants on the claim form had ‘sufficient commonality’ in relation to the issues to be determined and if it was convenient for such issues to be disposed of together, then a single set of Proceedings would be justified.
Consequently, all 3,449 claims could be issued using a single Claim Form. This is a welcomed decision, not least because of the significant backlogs and pressures presently facing the Court system.
