The Financial Services Compensation Scheme (FSCS) is now open to considering claims regarding Westway Holdings Bonds.

What was Westway Holdings Ltd and what went wrong?

Westway Holdings Ltd was a property developer investment company, operating in the Supported Housing sector. Between 2016 and 2020 their business involved selling as high-risk bonds & ISA products stating that they would be secured against company assets. These products were not properly backed by company assets and the company collapsed into administration in May 2020 after interest payments to investors stopped sometime in 2019. As a result of this, many investors have faced significant financial loss.

Westway Holdings’ directors are facing criminal prosecution and until recently, most investors have been unable to recover the funds they invested from Westway Holdings.

Neither Westway Holdings Ltd nor the investments they offered were regulated by the Financial Conduct Authority (FCA). This means that the investments were not covered by the Financial Services Compensation Scheme (FSCS) or the Financial Ombudsman Service (FOS). This means that you can’t claim directly against Westway but, this may not mean that you cannot recover your money.

Claims in relation to Westway Holdings Ltd

In a recent development, investors who invested into Westway Holdings bonds or other financial products may now qualify for compensation. The FSCS have investigated two separate companies linked to the Westway investments and have started accepting, and awarding compensation against these companies. This means that depending on when you invested, you may be eligible to seek compensation for your losses.

We have already helped Westway Holdings investors succeed in recovering their losses.

How do I know if I am eligible for a claim?

If you ever invested into Westway Holdings product, you may qualify for compensation. Get in touch with our team of in-house Financial Litigation specialists and we will be able to advise, assess your case and help you to recover your losses.

Curzon Capital Ltd & Westway Holdings

The FSCS have further investigated the activities of Curzon Capital Ltd in relation to the Westway Property Bond. As a result, the FSCS now consider that some investors who invested into the Westway Property Bond may have valid claims against Curzon Capital.

If you think you may have a claim against Curzon Capital, please contact us using the form to the right hand side of the page or give us a call. It’s important to get in touch as soon as possible as you may be running out of time to begin a claim and delay could put your compensation at risk.

Do I need a Solicitor to apply for compensation?

You do not need to instruct a Solicitor to pursue compensation, and you can present the claim for free against the Financial Services Compensation Scheme (FSCS) free of charge. However, such claims can be complicated and time consuming, and you stand a much better chance of success with the expertise and guidance of a legal representative.

Why should I use a Solicitor?

The Law surrounding Financial Litigation is complex and ever-changing. To be able to identify a problem with your financial product, first of all you have to know what you are looking for. Once you have identified the issue, you then need to be able to articulate the problem with reference to any legal or regulatory frameworks. By using a specialist solicitor, you will ensure that you put your best case forward and maximise your chance of success.

We have seen numerous cases in the past where investment mis-selling victims have pursued a legitimate claim themselves, only to have it turned down due to a technicality or because key grounds have not been particularised. You have a higher chance of success by working with a Solicitor, who will ensure that there are no technical grounds for turning down your mis-sold pension claim and put you in the best possible position to receive what you are owed.
